A police officer who refuses to file an FIR is prosecuted for committing a criminal offense under Section 166A(c) of the Indian Penal Code. The Supreme Court has ruled that in such situations, the police officer is liable for prosecution and sanctions.

New Delhi (India), October 16, (PNN): Have you ever been victimized, discriminated against, or bullied and you didn’t respond because you weren’t sure whether you could or not?Well, it’s time to empower yourself legally and recognize your rights as an Indian citizen.Although most of us Indians are familiar with some of our basic civil rights, here are a few of them which may surprise youThe right to file an FIR- A Police officer cannot refuse to file an FIR under the Indian Penal Code, 166 A.You have the right to file an FIR for a recognizable offence as an Indian citizen, and a police officer who refuses to file an FIR is prosecuted for committing a criminal offense under Section 166A(c) of the Indian Penal Code.

How to exercise this rightVisit the police station (ideally near the crime scene) and provide all the necessary information to the officer in charge.Section 154 of the CrPC gives the informant the ability to provide information verbally or in writing.Note: If the accused officer refuses to file a first information report concerning a felony in his territorial jurisdiction, the officer in charge has the option of submitting a complaint by email or even by post.: (a)Approach of the Superintendent of Police:If the informant cannot obtain a refund or a full refund by the police after submitting a complaint to the Superintendent of Police, the Superintendent of Police, or the Commissioner of Police may sue him, or request a police investigation.In the event the information is not disclosed, the Superintendent of Police may file a petition to the Judicial Magistrate, Metropolitan Magistrate, pursuant to Article 190 of the criminal procedure.If the funds are yet to be reimbursed, file a claim in the consumer forum about a service error.

125, the defaulters are not automatically subject to sanctions.In the case of a neglect case, parents (father or mother, whether biological, adoptive, stepfather, or stepmother, whether elderly or not) have the right to demand that their adult children pay their dues.Avail the court with evidence that your sons daughters, who are able to support you, have neglected to do so.Any individual may request for pension and be expected to pay the same.4- The Equal Remuneration Act of 1976 provides for equal pay for equal labor performed by both men and women.Employees have the right to lodge a complaint with the appropriate labor department if an employer violates these rules.Careers are urged to keep a record of their employees’ compensation in order to ensure that they are not being discriminated against.Note: When an employer breaches these rules, the appropriate labor department can initiate an investigation and take the necessary action.

Under no circumstances will a female police officer arrest a woman.What to do if your right is violated By the Motorcycle Act, 1988, a traffic police officer must:(a)Refuse her arrest if the arresting police officer does not follow the proper procedure of law.(b)Remind the arresting police officer of her rights to file a lawsuit against her.7- Your right to file a lawsuit against a police officer who isn’t wearing a uniform.If a police officer is approached by the victim, he or she would not attempt to assist because she is not on duty.8- No company can fire a pregnant woman under the Maternity Insurance Act, 1961.It may result in a maximum of 3 years in prison.

Without knowing these essential legal rights, you can have a negative effect on everything from your personal safety to your workplace security.
